Please read these Terms and Conditions ("Terms") carefully before using the Smart Websites platform operated by MountainView AI LLC ("we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

By creating an account or using any part of our platform, you confirm that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using our services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Services

Smart Websites provides an AI-powered website builder and static file hosting platform. Our services include AI-generated website content, static website hosting with SSL/TLS, custom domain support, email forwarding (on eligible plans), and related tools. We reserve the right to modify, suspend, or discontinue any aspect of the services at any time with reasonable notice.

3. Accounts

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Promptly update your information if it changes
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Subscriptions and Payment

Our services are offered on a subscription basis. By subscribing to a paid plan, you agree to the following:

  • You authorize us to charge your payment method on a recurring monthly basis at the rate associated with your selected plan
  • All fees are listed in U.S. dollars and are non-refundable except as described in our refund policy
  • We offer a 14-day money-back guarantee on all paid plans
  • Domain purchases are final and non-refundable. Once a domain registration is completed, no refund will be issued under any circumstances, including accidental purchases or unused domains
  • Domain renewals are billed annually. If a domain renewal payment fails and the domain expires, we are not responsible for the loss of that domain
  • You may upgrade, downgrade, or cancel your subscription at any time through your account settings
  • If you cancel, you will retain access to paid features until the end of your current billing period
  • We reserve the right to change pricing with 30 days' advance notice

Payment processing is handled securely by Stripe. We do not store your full credit card details on our servers.

5. Acceptable Use

You agree not to use our services to:

  • Violate any applicable law, regulation, or third-party rights
  • Host, distribute, or link to malware, viruses, or other harmful software
  • Distribute spam, phishing content, or fraudulent material
  • Host content that is defamatory, obscene, threatening, or promotes violence or hatred
  • Infringe on the intellectual property rights of others
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the platform to conduct any illegal activity
  • Resell or redistribute our services without written permission

We reserve the right to remove content or suspend accounts that violate this acceptable use policy, with or without notice.

6. Your Content

You retain ownership of all content you create, upload, or publish through our platform ("Your Content"). By using our services, you grant us a limited, non-exclusive license to host, store, display, and distribute Your Content solely for the purpose of providing and improving our services.

You are solely responsible for Your Content and represent that you have all necessary rights to publish it. We do not monitor or endorse user content but may remove content that violates these Terms.

7. AI-Generated Content

Our platform uses artificial intelligence to generate website content, including text, layouts, and design suggestions. While we strive for quality, AI-generated content is provided "as is" and may require your review and editing. You are responsible for reviewing all AI-generated content before publishing and ensuring it is accurate, appropriate, and does not infringe on third-party rights.

8. Domain Purchases, Custom Domains, and Email Forwarding

If you purchase a domain through Smart Websites, you acknowledge and agree that all domain purchases are final and non-refundable. Domain registrations are processed immediately with our registrar upon payment and cannot be reversed. An annual renewal subscription will be created automatically at the registrar's renewal price; it is your responsibility to ensure your payment method remains current to avoid domain expiration.

If you connect an externally registered custom domain or use our email forwarding feature, you are responsible for maintaining ownership of that domain and complying with your domain registrar's terms. We are not responsible for domain registration, renewal, or disputes with third-party registrars. Email forwarding is provided as a convenience and is not a substitute for a full email hosting service.

9. Intellectual Property

The Smart Websites platform, including its design, code, features, logos, and documentation, is the property of MountainView AI LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of our platform without our written consent.

10. Uptime and Availability

We strive to maintain 99.9% uptime for hosted websites. However, we do not guarantee uninterrupted service and are not liable for downtime caused by maintenance, third-party service outages, force majeure events, or circumstances beyond our reasonable control. We will make reasonable efforts to notify you of planned maintenance in advance.

11. Limitation of Liability

To the maximum extent permitted by law, MountainView AI LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of our services. Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be error-free, secure, or available at all times.

13. Indemnification

You agree to indemnify, defend, and hold harmless MountainView AI LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the services, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We may suspend or terminate your account and access to our services at any time for violation of these Terms, with or without notice. Upon termination, your right to use the services ceases immediately. You may request a copy of Your Content within 30 days of termination, after which we may delete it. Sections of these Terms that by their nature should survive termination will remain in effect.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the services shall be resolved in the state or federal courts located in Colorado.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should discontinue use of our services.
